April 13, 2010 Board Room 10:00 AM The Sac County Board of Supervisors met in regular session with all members present, Dean Stock, Chairman, presiding. The minutes of the last meeting were approved as submitted. It was moved by Hecht and seconded by Bensley to amend the agenda to review the hazard mitigation plan through FEMA. Ayes all, motion carried. It was moved by Bensley and seconded by Hecht to approve the agenda as amended. Ayes all, motion carried. It was moved by Hecht and seconded by Bensley to approve the County Recorder’s quarterly report for the quarter ending March 31, 2010. Ayes all, motion carried. Chad Schreck, regional planner with Region XII Council of Governments and Jim Bullock, Sac County EMA Director met with the Board to review the status of Sac County’s multi-jurisdictional hazard mitigation plan as required by Federal Emergency Management Administration. No action was taken as everything appeared to be current. At 10:30 AM, the Chairman opened the public hearing on annexation of lands to Drainage District 73 as proposed by the drainage engineer. Those present included Colin McCullough, drainage attorney and Ivan Droesler, drainage engineer. No landowners were present and there were no written or oral objections to the proposed annexations filed with the Auditor’s office. It was moved by Hecht and seconded by Bensley to close the public hearing. Ayes all, motion carried. It was moved by Bensley and seconded by Hecht to approve the engineers report and proceed with the notices to landowners on annexation. Ayes all, motion carried. There was brief discussion on combining DD 21 with DD 73 as all of DD 21 lies within the boundaries of DD 73. It was the consensus of the group that DD 21 should remain a separate district as no action has been taken to dissolve the district. The question of annexing 1.95 acres, Lot A in the SE ¼ of SE ¼ of Section 21 and 17.0 acres in SW ¼ of SW ¼ of Section 22, all in Cedar Twp into DD 73 came up after the decision to leave DD 21 as a separate district. These acres were part of the engineer’s report on annexation to DD 73 but are actually in DD 21. It was moved by Bensley and seconded by Hecht to reconsider his motion of approving the engineer’s report on annexation of lands to DD 73. Ayes all, motion carried. It was moved by Hecht and seconded by Bensley to exclude the 17 acre parcel in Section 21 and the 1.95 acre parcel in Section 22, Cedar Twp and approve the Engineer’s report as amended and to maintain District 21 as a separate district. Ayes all, motion carried. It was moved by Hecht and seconded by Bensley to approve the contract with OK Construction Co of Schleswig, Iowa for the cleanout and repairs on DD 73. Ayes all, motion carried. At 11:00, the Chairman opened the public hearing on Right of Way acquisition along the open ditch in Drainage District 73. The Engineer and the Board of Supervisors reviewed the additional right of way proposal of 6.85 acres, which would establish a 100’ right of way along the entire open ditch. The proposal suggested a purchase price of $400 per acre compensation for easement purposes along the ditch, for a total $2,740.00. There were no written or oral objections to the proposal filed with the Auditor’s office and no one was present for the hearing. It was moved by Hecht and seconded by Bensley to close the public hearing. Ayes all, motion carried. It was moved by Bensley and seconded by Hecht to approve the Engineer’s report on annexation and approve payment to the appropriate landowners for the additional easement. Ayes all, motion carried. The County Engineer updated the Board on activities of the county road crews and the status of current maintenance and construction projects. It was moved by Bensley and seconded by Hecht to authorize the Chairman to sign contract with Vogel Traffic Services for pavement markings in the amount of $38,999.33. Ayes all, motion carried. It was moved by Hecht and seconded by Bensley to approve and sign the Sac County DOT budget and five year program. Ayes all, motion carried.
